These Terms & Conditions (“Terms” “T&C”) constitute a legally binding agreement between you (whether as a therapist or Client) and PractiPal LLP (“PractiPal,” “we,” “our,” or “us”) governing your use of the PractiPal, a web-based platform and services (“Platform”).

Note: These Terms & Conditions govern the rules of use for the Platform. They are distinct from our Privacy Policy, which explains how we collect, process, and protect your personal data.

1. Eligibility & Account Registration

Use of the Platform is restricted to individuals aged 18 years and above or those who access it under verified parental or guardian supervision.

Therapists must be licensed or certified mental health professionals in accordance with Indian laws and ethics.

Clients must provide truthful information including an emergency contact person (alternative contact) whose details may be used in emergencies.

Users are solely responsible for maintaining the confidentiality of their login credentials and all activity under their account.

2. Scope of Service

The Platform allows Therapists to manage therapy sessions, client communications, diagnostic notes, and billing.

Clients can access session history, resources shared by their therapist, payment logs, and appointment features.

PractiPal is not a healthcare provider and does not offer medical or therapeutic advice. The therapeutic relationship and decisions lie solely between the Therapist and the Client.

PractiPal does not recruit, onboard, verify, or recommend Therapists to Clients. All Therapists using the Platform do so independently and bring their own pre-existing clientele to the Platform. PractiPal does not function as a therapist discovery or marketplace platform.

3. Acceptable Use & Code of Conduct

Users agree not to misuse the Platform or engage in unlawful, harmful, defamatory, or abusive conduct.

Therapists agree to adhere to professional codes of conduct and applicable laws regarding confidentiality and recordkeeping.

Clients agree not to impersonate others or use the Platform for non-therapeutic purposes.

4. Emergency Situations

In case of an Emergency, a situation where a Therapist reasonably believes that there is a serious risk of harm to the Client or others, the Therapist may disclose relevant personal data to:

The Client’s emergency contact or

Legal enforcement authorities.

 Such disclosure shall be limited to what is strictly necessary to prevent any harm.

5. Payments & Fees

Therapy fees are set and collected by individual Therapists.

Payments are processed through third-party gateways (e.g.,Razorpay etc.,);

PractiPal does not store payment details unless the parties choose the available add-ons which allow payments to be processed through PractiPal.

In the event that the parties using the platform choose to route payments through PractiPal, the Payments made by clients are collected by PractiPal via third-party payment gateways on behalf of the therapists. Due to integration constraints, such amounts are held temporarily by PractiPal and will be disbursed to the respective Therapists on a periodic settlement basis. PractiPal is not liable for any delays or payment disputes arising from payment gateway processing or incorrect Therapist account information

Refunds or rescheduling policies are subject to the individual Therapist’s terms.

6. Intellectual Property

PractiPal retains ownership over the Platform’s technology, design, and branding.

Therapists and Clients retain ownership of any original content they input, such as notes, documents, and forms.

By using the Platform, users grant PractiPal a limited license to use their content strictly for service facilitation.

7. Privacy & Data Use

Data processing and privacy practices are governed by our Privacy Policy.

We do not sell personal data. Sensitive personal data is protected by encryption and role-based access controls.

8. Platform Limitations & Disclaimers

The Platform is provided on an “as-is” and “as-available” basis.

PractiPal does not guarantee uninterrupted service or therapeutic outcomes.

PractiPal plays no role in the establishment, verification, or suitability of the therapist-client relationship. We are not liable for the clinical care, onboarding process, or professional conduct of Therapists using the Platform. PractiPal shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits, revenue, goodwill, or data.

Nothing in these Terms shall restrict any rights available to consumers under the Consumer Protection Act, 2019 or any other applicable Indian law, to the extent where such rights are mandatory and cannot be contractually waived.

9. Termination

PractiPal may suspend or terminate access for violations of these Terms or misuse of the Platform.

Users may terminate their account at any time. Upon termination, users may request deletion or export of their personal data, subject to legal and regulatory obligations.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India.

Courts in Visakhapatnam shall have exclusive jurisdiction over all disputes.

Users must first raise complaints through our Grievance Officer before seeking judicial remedies.

11. Amendments

We may revise these Terms periodically. Significant changes will be communicated through email or notifications on the Platform.
